General Terms and Conditions

1. Scope

For all orders in our online shop by consumers and companies following terms and conditions apply.

A consumer is a natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.

Company is a legal or natural person or an entity with legal capacity, which acts in exercise of its commercial or independent professional activity when concluding a legal transaction.

Company using conflicting or supplementary general terms and conditions: their validity is hereby objected; above become part of the contract only if ThePure Switzerland GmbH issues a separate agreement or contract.

2. Contracting party, conclusion of contract

The contract for service or sale of ThePure. bracelet, wristband hand sanitizer, cleaning bracelet or any other product presented is executed with ThePure Switzerland GmbH, Färberstrasse 19, CH-8832 Switzerland.

Pictures and presentations of products in the online shop are not a legally binding offer but present a non-binding online catalogue.

You may put our products into your shopping cart/basket without any obligation and correct your choice at any time before submitting your binding order.

Clicking on the order button, you place a legally binding order for the goods contained in the shopping cart/basket. The confirmation of receipt of your order is sent via e-mail directly afterwards placing the order.

Contract execution depends on the payment method you chose. We ship within 24h upon payment receival or upon availability.

3. Contract language, contract text storage

The language available for the conclusion of the contract is German.

4. Terms of delivery

Shipping costs are added to product prices. You can find out more about shipping costs in the shipping tab area.

Delivery is done by mail, personal pick up is not provided.

Shipping cost for returns are covered by buyer.


5. Payment

Following payment methods are available:

If you choose prepayment, we will send you our bank details in a separate e-mail and deliver the goods after receipt of payment.

Alternatively, you can prepay by check-out with provided payment methods (AMEX, Apple Pay, Google Pay, Klarna, Mastercard, Maestro, PayPal, Bank Transfer, TWINT, SOFORT, VISA). Please note payment methods may differ per country

Vouchers and Coupons

Vouchers are provided to the customer as follows:

  • per Download

  • by e-mail

  • postal

Vouchers cannot be waved into cash payment.

6. Right of withdrawal/Cancelation right

Consumers are entitled to the statutory right of withdrawal as described in the cancelation policy. Companies are excluded.

7. Retention of title

The goods (i.e. sanitizing bracelet, desinfection wristband, hygiene brace and other goods and services) remain ThePure. Switzerland GmbH property until full payment has been received.

For companies the following applies additionally: We reserve the right of ownership of the goods until all claims from an ongoing business relationship have been settled in full. You may resell the reserved goods in the ordinary course of business; you assign to us in advance all claims arising from this resale – irrespective of any combination or mixing of the reserved goods with a new item – in the amount of the invoice amount, and we accept this assignment. You remain authorized to collect the claims, however, ThePure. Switzerland GmbH may also collect claims ourselves if you do not meet your payment obligations.

8. Transport damage

Consumers: when you observe any transport damage of goods delivered, please complain about such defects to the delivery agent as soon as possible and contact us contact us via mail: info@thepure.care

Companies: risk of accidental loss or deterioration waves to you as soon as ThePure. Switzerland GmbH passed items to shipping company, the carrier or any other person or institution designated to carry out the shipment. Among merchants, the obligation to examine and give notice of defects applies. If you fail to make the notification regulated there, the goods shall be deemed to have been approved, unless it is a defect that was not recognizable during the inspection. This shall not apply if we have fraudulently concealed a defect.


9. Warranty and liability

Unless agreed otherwise, the statutory liability for defects shall apply. In general, please approach us with any claim and we will try to work out a solution which will satisfy the customer.

Generally, for the purchase of used goods by consumers, the following applies: if defect occurs after one year (12 months) from delivery of the goods, claims for defects are excluded.

Defects that occur within one year after delivery of goods can be claimed within this time in written form at you@thepure.care

For Companies, the limitation period for claims of defects in newly manufactured goods is one year from the transfer of risk. The sale of used goods takes place under exclusion of any warranty.

In relation to companies, only ThePure. Switzerland GmbH own information and the manufacturer’s product descriptions included in the contract shall be deemed to be an agreement on the quality of the goods; ThePure. Switzerland GmbH shall not be liable for public statements by the manufacturer or other advertising statements.

If delivered item is affected or defect, ThePure Switzerland GmbH provides a warranty to Companies at our discretion either by eliminating the defect or by delivering a replacement.

Please keep away from small children as small parts may be swallowed.

10. Liability

Claims resulting from damages or danger caused or occurred by different use or application than according to provided instruction are excluded. Liability applies according to GmbH/LLC definition by the Swiss Law.

11. Settlement of disputes

The European Commission provides an Online Dispute Resolution (OS) platform, which you can find here We are neither obliged nor willing to participate in dispute resolution proceedings in a consumer arbitration board.


12. Final statement

Swiss law applies. The court of legal disputes is Switzerland, Wollerau, Cantone Schwyz.
